In Connecticut, wrongful death cases are controlled by General Statutes Sec. 52-555. This law allows us to seek compensation for a client for the emotional suffering and financial hardship which results from the death of a spouse, parent or child. The law also allows us to seek payment of medical, hospital, nursing and funeral expenses in a wrongful death case.
The law allows an executor or administrator to bring a personal injury claim against the person or persons legally at fault for causing a person’s death. (If the deceased person left a Last Will, the executor is the person named in the Will to handle settlement of the deceased person’s estate. In Connecticut, a wrongful death law suit must be filed within a certain period of time — 2 years from the date of death but no later that 5 years from the date of the act that caused the death. Other laws with earlier deadlines may apply to your situation, such as if your loved one’s death was caused by the negligence of a government employee or of a person who sells liquor, or if the death was caused by a defective road or sidewalk.
